Dr. Angel Macagno was born and raised in Argentina where, as a board-certified physician, he practiced Orthopedic surgery for 15 years before deciding to fulfill his lifelong goal of practicing medicine in the United States.


Dr. Macagno completed his first spine fellowship at Miami Children’s Hospital, with Dr. Harry Shufflebarger and Dr. Michael O’Brien, where he specialized in complex spinal deformity in children and adolescents.


He then completed a surgical internship and orthopedic surgical residency at State University of New York at Downstate in Brooklyn, NY, followed by a second, ACGME-accredited, spine surgery fellowship at New York University Hospital for Joint Diseases in Manhattan, New York.


Dr. Macagno has participated in numerous research studies and has published several book chapters on spine-related topics. He is active member of multiple national and international societies, including the American Academy of Orthopedic Surgery, North American Spine Society and International Society for the Advancement of Spine Surgery.


Spinal injuries and complex deformities have an enormous impact on the lives of adults and children alike.  Unlike other injuries and conditions, spine problems are quite debilitating and often very painful ­– which can severely alter the quality of an individual’s life.


Dr. Macagno specializes in the diagnosis and treatment of spinal disorders and deformities, including reconstructive spine surgery for children, adolescents, and adults. He is dedicated to helping people with spine conditions to actively restore their health.  He uses his exceptional training, including minimally invasive spine surgery, to eliminate symptoms and give patients the best and fastest possible chance of recovery and a better life.In collaboration with Health Volunteers Overseas,


Dr Macagno donates his time and expertise to medical missions to Nicaragua to provide life-changing and lifesaving procedures to people with severe spinal deformities such as scoliosis, kyphosis, spondylolisthesis, tumors, and trauma; helping at the same time to teach local medical teams advanced spinal techniques.


Communication is important to him and he speaks Spanish, Portuguese and English fluently. He believes the patient’s time is as valuable as his own. Trying to be on time with every scheduled appointment is one of his many ways of showing respect to his patients.

Motion for summary judgment


In opposition, plaintiff contends that he suffered a serious injury under the permanent consequential limitation of use of a body organ or member, significant limitation of use of a body organ, member, function or system, and 90/180 categories of serious injury. To support such contention, plaintiff submits a narrative report from Angel Macagno, M.D. from New York Spine Institute. Dr. Macagno examined plaintiff on February 21, 2019. Plaintiff presented with significant lower back pain radiating to bilateral lower extremities and neck pain. Plaintiff reported to Dr. Macagno that he was involved in a prior car accident twelve years ago that resulted in neck and back pain that resolved completely with conservative treatment. Plaintiff also reported that he did not have any more episodes of neck or lower back pain until the subject accident. Dr. Macagno indicates that he reviewed plaintiff's MRI of the cervical spine taken on April 10, 2017, the MRI of the lumbar spine taken on April 11, 2017, the MRI of the lumbar spine taken on February 21, 2019, the CT scan of the lumbar spine taken on February 21, 2019, and the X-rays of the lumbar spine taken on February 21, 2019. Dr. Macagno performed range of motion testing with a goniometer and found decreased ranges of motion in plaintiff's cervical spine and lumbar spine. Dr. Macagno concludes that the current problem is causally related to the subject accident and the resultant injuries are permanent.

Angel Macagno, MD is a physician board certified in Orthopedic Surgery and advanced training in disorders of the spine. On September 22, 2020, this doctor performed measured range of motion testing using a goniometer, and found that plaintiff had reduced range of motion of 30 degrees of flexion, (60 degrees normal) 20 degrees of extension (45 degrees normal), and 20 degrees of lateral flexion bilaterally (45 degrees normal). This doctor's impression was that plaintiff will need lumbar surgery, if her symptoms do not improve and if her condition continues to worsen. Based upon his review of the MRI, this doctor's physical examinations and the history provided, the diagnosis is that plaintiff sustained herniated extruded disc herniations at L4-5 and L5-S 1, with loss of disc height and lumbar radiculopathy. It is also this doctor's opinion, that plaintiff's injures are causally related to the January 23, 2017 motor vehicle accident, and that plaintiff has sustained a permanent consequential and significant limitation of her lumbar spine, low back and peripheral nervous system, which is causally related to the injuries diagnosed and the motor vehicle accident (NYSCEF#67).
